By creating an account or using Ketone, you acknowledge that:

• You agree to our Privacy Policy, which is incorporated by reference.
• You are legally capable of entering into binding contracts.

1.2 Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes through:

• In-app notifications.
• Email notifications.
• Updating the "Last Updated" date on this document.

2.1 Age Requirement

You must be at least 18 years old to use Ketone. By using the App, you represent and warrant that you meet this age requirement.

2.2 Account Registration

To access most features, you must:

• Provide accurate and complete registration information.
• Maintain the security of your password.
• Keep your account information up to date.
• Not share your account credentials.
• Be responsible for all activities under your account.

3.1 Not Medical Advice

IMPORTANT: Ketone is a wellness, fasting tracking, and information tool, NOT a medical device or service.

• The App does not provide medical advice, diagnosis, or treatment.
• Content is for informational and educational purposes only.
• Always consult a qualified healthcare provider before starting any fasting, diet, or exercise program.

3.2 AI Disclaimer (Generative AI)

The "AI Coach" feature utilizes artificial intelligence (e.g., Gemini API) to generate responses.

• Accuracy: AI may occasionally generate incorrect, misleading, or "hallucinated" information. Do not rely on the AI Coach for critical health decisions.
• No Professional Review: Responses are automated and have not been reviewed by doctors or nutritionists.

3.3 Health Risks

Intermittent fasting and dietary changes may not be suitable for everyone, strictly including:

• Pregnant or breastfeeding women.
• People with eating disorders or history of disordered eating.
• Individuals with diabetes or blood sugar issues.
• Those with certain medical conditions or taking specific medications.

3.4 Emergency Situations

If you experience a medical emergency, call emergency services immediately. Do not rely on Ketone for urgent medical needs.

4.1 Subscription Plans & Pricing

Ketone offers auto-renewing subscription options (e.g., Monthly, Annual).

• Pricing: Current pricing and subscription details are displayed clearly within the App at the time of purchase. Prices are subject to change, and localized prices may vary by country.
• Changes: We reserve the right to change subscription prices. You will be notified of price changes in advance, and changes will apply to subsequent billing cycles.

4.2 Free Trial

We may offer a free trial at our discretion.

• You will be automatically charged the applicable subscription fee when the trial ends unless you cancel at least 24 hours before the trial expiration.

4.3 Billing and Renewal

• Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• Billing: Your account (Apple ID) will be charged for renewal within 24 hours prior to the end of the current period.

4.4 Cancellation

• You can manage and cancel your subscription at any time via your Apple ID Settings (for iOS) or Google Play Settings (for Android).
• Effect: Cancellation takes effect at the end of the current billing period. You will continue to have access to premium features until that date.
• No Partial Refunds: We do not provide refunds for partial subscription periods once a charge has been processed.

7.1 Our Ownership

Ketone and all its contents, features, and functionality are owned by Omar Leal and protected by copyright, trademark, and other intellectual property laws. This includes:

• App design, source code, and interface.
• AI Coach prompt engineering and logic.
• Logos, branding, and graphics.

7.2 Your License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App for personal, non-commercial purposes.

7.3 Your Content

You retain ownership of data you create (logs, notes). By using the App, you grant us a license to store and process your content to provide the service.

9.1 "As-Is" Service

KETONE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR:

• Indirect, incidental, special, or consequential damages.
• Health complications, injuries, or death resulting from your use of the App.
• Inaccuracy of AI-generated content.
• Damages exceeding the amount you paid to us in the last 12 months.

12.1 Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles.

12.2 Informal Resolution

Before filing a claim, you agree to contact us at omarenriquelealr@gmail.com to attempt to resolve the dispute informally for at least 30 days.
